Any Plot With A Legally Clear Title And Approved Plot Layout Is Entitled To An Independent 7/12 Document. The Plot Layout Is Eligible For An Individual 7/12 Title If It Has The Necessary Stamping Of The Concerned Government Authorities And Approvals From Town Planning. In The Absence Of These Documents, This Investment Is Risky And Not Advisable.

Land Investments Done Within City Limits Should Be Clearly Declared As NA Plots And If Not So, Should Be Converted To The Same Promptly. Initially Before Purchasing The Land, The Necessary Paperwork To Be Checked For Are Government NOC’s For Electricity (MSEB), Water Supply Etc. Any Indian Residing Outside India For More Than 180 Days Is Considered As An NRI Even If He Working There And Is Staying Temporarily. The General Land Investment Rules For NRIs Are Slightly Different Compared To The Regular Residents Of India. The Most Important Thing That Needs To Be Kept In Mind When A NRI Is Investing In Land In India Is That They Can Only Invest In NA Lands That In Non Agricultural Land, They Cannot Directly Invest In Agricultural Land Or Farm House NA. So While Buying They Need To See What Type Of NA It Is As They Can Invest In Any Other NA Apart From Farm House NA And Agricultural Land.

Buying An Agricultural Land Which Is Survey No. And Around 3000 Sq. Ft. In City Limits….
It Is Very Important To Know That To Buy An Agricultural Land You Need To Have The Agricultural 7/12 On Your Name That Is You Should Be An Owner Of An Agricultural Land Already When You Plan To Buy New One. In Survey No If The Area Is 3000 Sq. Ft. You Do Get 7/12 On Your Name And Hence Own The Land If The Previous Owner Holds A 7/12 Document On His Name. Another Very Important Aspect That Needs To Be Kept In Mind Is The Actual Purpose Of The Purchase. You Can Only Use This Land For The Cultivation Purpose, So If You Are Buying It In The City Limits And Wish You To Build On It In The Future It Is Not Going To Serve The Purpose As To Construct You Need A NA Land Or A Land That Is In R Zone And Hence It Contradicts Your Purpose Of Investment. According To The Hindu Succession Act 1956 Section 8 A Combine 7/12 Can Happen Only With The Heirs Of Class I Section As According To The Segmentation Act There Can Be Only 2 People On A Combine 7/12. Reshma: Vaibhav If You Have Decided On Any Clear Title Project It Is Always Better To Get It Checked From Your Lawyer And If Everything Is Ok The Further Processes Will Take Place Like The Sale Deed Will Be Made And You Will Have The 7/12 On Your Name. If We Talk About Benefits, The Major Benefit Is That Once You Have The 7/12 On Your Name You Are Officially The Owner Of The Place. Other Than That Are Three Other Benefits That We Can Speak Of Is If You Plan To Keep It As Long Term Investment And Keep The Plot Empty The Rate Will Still Appreciate As The Area In The Vicinity Develops. Reshma: Vijayji Town Planning Is The Layout Which Has All The Long Term Future Development Also Considered In It. Like When We Invest In A Non Agricultural Land Even If It Is As Small As 5 Acres We Have To Leave Amenity Spaces In It Taking In Consideration The Future Development Of The Area Such As Highways, Airports And Considering That The Sizes For The Roads, Space For Kids To Play Or Any Commercial Development As Well. The Reason It Is Made Compulsory Now Is Because In The Past All These Things We Not Taken In Consideration Resulting In Congested Cities. So When We Get A Town Planning Approval The Future Development Of At Least 50 Years Is Taken In Consideration.

With The N/A Approvals, Town Planning Approval And Other Construction Approvals Now It Is Necessary To Get RERA Approval As Well. So Now Without The RERA Approval No Project Can Be Launched In The Market Officially Which Will Also Put On Impact On The Pre-launch Or Pre-booking As It Will Not Be Allowed To Do So. This Real Estate Authority Bill Has Been In Place Since March And The Forming Of The Authority Is Taking Place Now. This Will Also Help In Building The Transparency As All The Builders And Developers Will Have To Display The Actual Status Of The Projects Including The Current Rate Of The Project, Number Of Plots Or Flats Sold Till Date On Their Website Which Will Help The Buyer To Understand The Project On One Platform. And The Most Important Fact That Will Bring Transparency Is That The Builders Or Developers Will Have To Give The Development Commitments Of The Authority. And If The Commitment If Not Fulfilled The Builder Will Be Fined. Similarly The Buyers Will Also Have To Abide By The Commitment That Is Given By Them As They Have To Do The Payments According To The Payment Schedule And At Times Even They Default In The Payments And A Fine Will Be Applied To Them As Well By The Authority. Hence This ACT Safeguards Both Of Them The Buyer As Well As The Seller.

The Demarcation And Layout Of These Plots Are Not Approved By Any Government With A Thought Process That Once The NA Is Done The Plots Will Be Allotted. In Such Case Agreement To Sale Is Made So That Once The NA Is Done The Client Will Be Handed Over The Ownership Of His Plot. At Times When People Buy Such Plots There No Legal Documentation Done, The Only Document Made Is Agreement To Sale And Throughout That Period There Is No Title On Your Name, Which Means You Are Still Not The Owner Of That Place.

Anchor: What I Would Like To Know Is That We Generally Do Land Investment As Future Investment Or The Investment That Can Be Useful In The Future And What All Precautions Do We Need To Take For It?

Reshma: The Precautions That We Need To Take Care That If You Are Looking For Investments You Can Invest In Agricultural Plots Which Needs To Be Minimum 1 Acre If You Have 7/12 On Your Name You Can Buy It Legally And If Not So I Would Suggest You Invest In NA Plots And While Doing So You Should Ask The Developer For The NA Order That Is An Government Order That Officially Declares That Land Non Agriculture Approved. If They Have This Order Then That Project Is NA If Not Then It Is A Proposed NA Project. If It A Proposed NA All The Further Dealings That You Do Are Illegal For Which The Government Is Not Responsible. There Is Always A Possibility That On That Proposed Land The Government Decided To Build A Bus Depot And The Valuation Of That Land Reduces Automatically. And You Cannot Claim Anything As You Do Not Have The Legal Ownership Of That Land.

Secondly We Need To Check Is The 7/12 Of The Land On Which The Zone Of The Land Is Stated. This Is Very Important Because If You Want To Cultivate The Land Needs To Be Agricultural Land And If You Want To Build On That Land The Land Needs To Be Residential NA Land That Means Non Agricultural Approved.
